Welcome to Ultimate Trainer! These Terms and Conditions govern your use of the Ultimate Trainer Mobile Application (the "App"), operated by Ultimate Trainer LLC ("Company", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

By accessing or using Ultimate Trainer, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, as well as our Privacy Policy. We may update these terms at any time, and continued use of the App constitutes acceptance of the revised terms.

To use Ultimate Trainer, you must:

·  Be at least 18 years old or have parental consent if between 13 and 17.

·  Have the legal capacity to enter into a binding contract.

·  Not have been banned from using the App previously.

·  Ultimate Trainer provides fitness guidance but does not replace professional medical or fitness advice.

·  Always consult a physician before starting a workout program or app, especially if you have medical conditions, are pregnant, or have any injuries.

·  You assume all risks associated with using the App. We are not responsible for injuries, health complications, or any damages resulting from your use of Ultimate Trainer.

·  You will need to create an account to access the apps contents.

·  You are responsible for maintaining the confidentiality of your login information.

·  We reserve the right to suspend or terminate accounts that violate these Terms.

·  Ultimate Trainer offers free and premium subscription plans.

·  Payments are processed through the Apple App Store and Google Play Store and are subject to their terms.

·  Subscription renews automatically unless canceled at least 24 hours before the renewal date.

·  No refunds are issued for unused time in a subscription cycle, you will always have access until the expiration date.

·  All sales are final

·  The App, including all text, images, logos, and software, is the property of Ultimate Trainer and is protected under intellectual property laws.

·  You may not copy, modify, distribute, or create derivative works based on our content under any circumstance. 

By using the App, you agree not to:

·  Use the App for illegal or unauthorized purposes.

·  Harass, abuse, or threaten company personnel. 

·  Upload harmful software, such as viruses or malware.

·  Reverse-engineer, decompile, or attempt to extract the App’s source code.

·  Ultimate Trainer is provided "as is" and "as available" without warranties of any kind.

·  We do not guarantee uninterrupted or error-free service.

·  We are not liable for any technical issues, including data loss or security breaches, although we will do our best to prevent them.

·  We are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App.

You agree to indemnify and hold harmless Ultimate Trainer, its affiliates, and employees from any claims, liabilities, damages, or expenses resulting from your violation of these Terms or misuse of the App.

·  We reserve the right to terminate or suspend your access to the App at any time if you violate these Terms.

·  Upon termination, you must cease using the App, and any rights granted to you under these Terms will end immediately.

·  These Terms are governed by the laws of the State of Illinois, USA.

·  Any disputes will be resolved through binding arbitration in Illinois, unless prohibited by law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
